I. INTRODUCTION

This Privacy Policy governs the manner in which AlignOps (ToolWatch, LLC dba Align Technologies) and its subsidiaries and affiliates, which include but are not limited to busybusy, Inc., Safety-Reports, Inc., and FleetWatcher LLC (“AlignOps,” “Company,” “our,” “us,” or “we”) collect, use, maintain, and disclose information collected from users (each, a “User”) of the AlignOps platforms or applications available from https://alignops.com, https://busybusy.com,  https://www.safety-reports.com,  https://www.fleetwatcher.com or otherwise, and any successors to the foregoing (“Platform”), Users of any websites or other properties, including associated or successor websites, or properties, which refer to this Privacy Policy (collectively with the Platform, our “Website”), or Users who contact us through other communication methods such as email or phone. 

 This Privacy Policy applies to the Website and all products and services offered by AlignOps and describes the types of information we may collect from you or that you may provide when you interact with our Website, and our practices for collecting, using, maintaining, protecting, and disclosing that information. Except as otherwise described herein, this Privacy Policy does not apply to information collected through any other means indicated above, including on any other website operated by us or any third party or through any application or content (including advertising) that may link to or be accessible from our Website.

For purposes of this Privacy Policy, personal information means information relating directly or indirectly to an identifiable individual, except as may be set forth in applicable law.

Please read this Privacy Policy carefully. By accessing or using our Website, you consent to our collection, use, sharing, and disclosure of your personal information as described in this Privacy Policy. If any term in this Privacy Policy is unacceptable to you, please do not use our Website or provide us with any personal information.

Changes to this Privacy Policy. Align has the discretion to update this Privacy Policy at any time. When we do, we may post a prominent notification on our Website and/or send a notification to the email address associated with a user’s account. Any changes or updates will be effective immediately upon posting to this page. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this Privacy Policy periodically and become aware of modifications. Your continued use of the Website following the posting of changes to this Privacy Policy will be deemed your acceptance of those changes.

Residents of California, Colorado, Connecticut, Utah, Virginia, and other states with similar laws, and those located in Canada, have additional rights. II. INFORMATION WE MAY COLLECT & HOW WE COLLECT IT

We collect information about you in the following ways:

  1. Information You Provide or We Collect About You Directly

We collect several types of information from and about Users of our Website, which may include personal information. We may collect personal information from Users in a variety of ways, including but not limited to when Users: visit our Website, register on the Website, place an order, fill out a form, respond to a survey, and in connection with other activities, services, features or resources we make available on our Website. 

Information we may collect when provided by you includes:

  • Personal details such as name, email address, telephone number, company name, job title, other professional information, photos, biometric information (as further detailed below), and personal identification information
  • Account information such as account login credentials such as username and password
  • Financial information such as Billing and payment information (e.g., credit card or ACH account information)
  • Views and opinions such as feedback, survey responses, and other information included within your interactions with us or otherwise provided via the Website
  • Communications information such as transcript of chat message transcripts, phone, or video calls, such as when you communicate with us via a chat functionality on the Website or provide us with feedback

Recruiting and Candidate Information

If you choose to apply to work with or for AlignOps through our Website or by otherwise contacting us regarding opportunities to become an employee, agent, or contractor for us, we may collect the following: 

  • Contact information such as your first and last name, email and mailing addresses, phone number, professional title or profession, and company name if applicable.
  • Application information regarding qualifications, skills, employment or education history, or other related information provided voluntarily in response to questions and during any interviews.
  • Reference Information, such as name and contact details of your references.
  • Social Media Information, such as if you provide us a link to or other access to a social media account, we may collect or access any information you permit to be shared through or from your social media account and other information depending on the social media platform.
  • Background Check Information, subject to applicable law.
  • Compensation information that you voluntarily provide, and which may depend on your region and applicable laws and regulations.

You are responsible for the personal information you provide or make available to us. All personal information you provide, particularly in connection with our recruiting activities, must be truthful, accurate and not misleading in any way. You may not provide information that is obscene, defamatory, infringing, malicious, or that violates any law. If you provide personal information of a third party, you are responsible for providing any notices and obtaining any consents necessary for us to collect and use such personal information as described in this Privacy Notice.

  1. Information We Automatically Collect About You

As with many websites and applications, when you interact with our Website, we may use automatic data collection technologies such as cookies, as explained in more detail below, to collect and log certain information about your device and how you use our Website.

 Information we may collect automatically includes:

  • Device information and other related identifiers such as cookie IDs, IP address, or other electronic identifiers, operating system, Internet service providers utilized, the type of device and technical information about means of connection to our Website, precise geolocation of your device or equipment you may be operating (for certain of our Platforms), and non-precise location data, such as location information we derive from your IP address or other device settings
  • Website usage and analytics information such as browsing actions, and patterns, including details of your visits to our Website (e.g., browser name, traffic data, logs, other communication data, and resources that you access and use on our Website)
  1. Web Browser Cookies

Our websites may use “cookies” to enhance User experience. Cookies are small data files that are placed on your computer or mobile device when you visit a website. Cookies are widely used by websites to make the websites work, better understand how site visitors use the website, and provide more targeted content to its site visitors. User’s web browsers places cookies on their device for record-keeping and website usage analytics purposes. Users may choose to set their web browser to refuse cookies, or to alert them when cookies are being sent. If they do so, note that some parts of the websites may not function properly.

  • Required Cookies: Required cookies are necessary for the operation, maintenance and/or security of our Website.
  • Functionality and Analytics Cookies: Functionality cookies remember choices you make (such as your language or the region you are in) and provide enhanced or more personal features. Opting out does not mean you will no longer receive online advertising. It does mean that the company or companies from which you opted out will no longer deliver ads tailored to your browsing preferences and usage patterns. You may temporarily continue to see some tailored ads produced from ongoing advertising campaigns.

The above opt-out tools rely on the use of cookies, and to the extent your browser settings impact use of third-party cookies, the above tools may not operate correctly. The above tools also apply only to the browser on which they are exercised. Do Not Track:

There are different ways to prevent tracking of online activities. Some web browsers may allow you to enable a do-not-track feature that alerts the websites you visit that you do not want your online activities to be tracked. Our Website may not recognize or react in response to do-not-track signals. At present, no generally accepted standards exist on how companies must respond to do-not-track signals. In the event a final standard is established, we will assess and provide an appropriate response to these signals.

We may receive personal information about you from third-party sources such as marketing partners, social media and other cloud-based platforms, identity providers, publicly available sources, business partners, data providers, or third-party staffing or personnel providers

  1. Sensitive Personal Information

Align recognizes that certain jurisdictions have enacted laws with different requirements regarding the processing of certain sensitive personal information. “Sensitive Personal Information” includes special categories of personal information identified by certain laws. Align does not require Sensitive Personal Information from you when using the Websites generally. In cases where we do seek to collect Sensitive Personal Information, for example when conducting recruiting activities or collecting biometric or precise geolocation information for certain of our Platforms as set forth above, we will seek to do so in accordance with applicable data privacy laws. Do not provide us with unsolicited Sensitive Personal Information.

III. HOW WE USE COLLECTED INFORMATION 

Align may use information, including personal information, we collect for the following business purposes:

  • To run and operate our Website and business. We may need your information to display content on the Website correctly and to otherwise provide, deliver, improve, secure, optimize, personalize, and analyze use of our Websites. We may also use your personal information to maintain the security of our other products and services as well as our databases, other technology assets, and business. The use of certain Sensitive Personal Information for selected Platforms only applies to the extent you enable or otherwise consent to certain features or functionality in the Platforms.
  • To improve customer service. Information you provide helps us respond to your customer service requests and support needs more efficiently and perform our contractual obligations.
  • To personalize user experience. We may use also information in the aggregate to understand how our Users as a group use the services and resources provided on our Website.
  • To process payments. We may use the information Users provide about themselves when placing an order only to provide service to that order. We do not disclose this information to outside parties except to the extent necessary to provide the service.
  • To conduct marketing activities. To send Users information, in accordance with applicable law, about topics we think will be of interest to them, including our Platforms, promotions, contests, surveys, or other similar programs.
  • To send periodic emails. We may use the email address to send User information and updates pertaining to their order. It may also be used to respond to their inquiries, questions, and/or other requests.
  • In the event of a business transaction. We may use information to in the event of a sale, merger, consolidation, change in control, transfer of substantial assets, reorganization, or liquidation, we may transfer, sell, or assign to third parties information concerning your relationship with us, including, without limitation, personally identifiable information that you provide and other information concerning your relationship with us.
  • For recruiting activities. To conduct recruiting and hiring activities for opportunities with Align. If you apply to work with or for us, we will review the information you submit to determine if your qualifications and experience match any available opportunities at Align, to verify the information you provide, communicate with you regarding any opportunities, improve our recruiting processes, process your onboarding if hired, and comply with applicable labor and employment laws.
  • For legal compliance. To Comply with any procedures, laws, and regulations which apply to us or our processing. For example, we comply with subpoenas and other court orders to process data where we have determined there is a legal requirement for us to do so.
  • Establish, exercise, or defend our legal rights. We may process your personal information in connection with establishing, exercising, or defending our legal rights where it is necessary for our legitimate interests or the legitimate interests of others or for fraud prevention. For example, we may process information you provide to identify any fraudulent, harmful, unauthorized, unethical, or illegal activity such as use of another individual’s identity and we may use your information as necessary to defend ourselves in litigation or enforce our rights or agreements with others.
  • Other legitimate purposes as required or permitted by applicable law. We may process your information for other purposes consistent with those in this Privacy Policy, as may be permitted or required by applicable law, as otherwise disclosed to you, or as otherwise with your consent.

IV. DISCLOSING YOUR PERSONAL INFORMATION

We do not sell, trade, or rent Users’ personal information to others. We may disclose generic aggregated demographic information not linked to any personal information regarding visitors and users to our business partners, trusted affiliates and advertisers for the purposes outlined above.  Align may disclose your personal information in the following ways:

  • Internally: We may disclose your personal information to our affiliates, business partners, employees, and other parties who require such information to assist us with establishing, maintaining, and managing our business relationship with you.
  • With Our Customers: We may disclose your personal information to our customers for employee timekeeping purposes.
  • With Our Service Providers or Contractors: We may disclose your personal information to our service providers or contractors (including third-party hosting providers) that provide services on our behalf, such as for email marketing, data analytics, promotions, newsletters, notices, and other communications, or that assist us in monitoring, improving, and hosting the Website.
  • With Our Business Partners: We may disclose your personal information to our third-party business partners that provide perks or other features to you via the Website, including, for example, certain third-party products or services. Please be advised that the third party’s own privacy policy may apply to its use of your personal information.
  • In the Event of a Business Transaction: If we are exploring or go through a business transition or financial transaction, such as a merger, acquisition, divestiture, restructuring, reorganization, dissolution, bankruptcy, securities offering, or sale of all or a portion of our assets, we may disclose your personal information to a party or parties in connection with exploring or concluding such transaction.
  • For Legal Purposes: We will disclose your personal information when we think it is necessary to investigate or prevent actual or expected fraud, criminal activity, injury, or damage to us or others; when otherwise required by law, regulation, subpoena, court order, warrant, or similar legal process; or if necessary to assert or protect our rights or assets.
  • With Your Consent or Authorization: To anyone for whom you have authorized disclosure of information in this Privacy Policy.
  • Other: We may disclose your personal information for any other purpose disclosed by us when you provide the information. 

V. BIOMETRIC DATA COLLECTION 

  1. Biometric Information You Provide or We Collect About You Directly

Align, its customers, its vendors, and/or licensors of Align’s Platforms that include time and attendance software collect, retain, and use facial recognition data for users of the Align time tracking app (“Tool”), who have opted in to the facial recognition feature with a signed Written Release for Collection and Use of Biometric Information (“Opt-In Users”). The Tool uses scanning technology to capture the geometry of each Opt-In User’s face (referred to as “biometric identifiers” and “biometric information”). Capturing face images of anyone other than yourself is not permitted. 

  1. Biometric Information Use

Align, its customers, its vendors, and/or the licensors of the Tool use biometric information of Opt-In Users for the purpose of enabling the Tool to recognize and record each Opt-In User’s face to verify the identity of employees and to record time entries when using Align’s biometric time clocks and/or time clock attachments. Biometric time clocks are computer-based systems that scan an employee’s facial geometry for the purpose of personal identification. The computer system extracts unique data points and creates a unique mathematical representation used to verify the Opt-In User’s identity, for example, when the Opt-In User arrives at or departs from the workplace. The mathematical representation is only used to verify the Opt-In User’s identity for timekeeping purposes. 

  1. Biometric Information Sharing

Opt-In Users’ biometric information will be stored by service providers on Align’s behalf and may be disclosed to our customers of Align’s time and attendance software for the purpose of verifying the correct Opt-In User is tracking time or updating a User’s profile picture, or may be disclosed to our vendors, and/or licensor for the purpose of troubleshooting and making other technological improvements. As required by law, we have entered into written agreements with our customers, vendors, and licensors to employ appropriate technical and organizational measures to secure all biometric information collected.

We will not sell, lease, trade, or otherwise profit from biometric information in any way. We will not disclose, re-disclose, or otherwise disseminate biometric information without the Opt-In User’s consent to the disclosure or re-disclosure, unless the disclosure is needed to complete a financial transaction that the Opt-In User has authorized, or the disclosure is required by law or subpoena. 

  1. Biometric Data Retention

We will retain Opt-In Users’ biometric information for no longer than is necessary to fulfill the purposes for which the information was originally collected. Within thirty (30) days after a period of three hundred and sixty six (366) days of inactivity with the Tool, the Company will permanently destroy all of your biometric information and biometric identifiers used in the biometric time clock system. 

  1. Opt-Out of the Facial Recognition Feature

If you want to opt-out of the facial recognition features, please contact your employer.

VI. THIRD PARTY WEBSITES

Users may find advertising or other content on our Website that link to the sites and services of our partners, suppliers, advertisers, sponsors, licensors and other third parties. This Privacy Policy does not apply to these third party websites. We do not control the content or links that appear on these sites and are not responsible for the practices employed by websites linked to or from our Website. In addition, these sites or services, including their content and links, may be constantly changing. These sites and services may have their own privacy policies and customer service policies. Browsing and interaction on any other website, including websites which have a link to our Website, is subject to that website’s own terms and policies.

VII. ELECTRONIC NEWSLETTERS

If User decides to opt-in to our mailing list, they will receive emails that may include company news, updates, related product or service information, etc. We may use third party service providers to help us operate our business and the Website or administer activities on our behalf, such as sending out newsletters or surveys. We may disclose your information to these third parties for those limited purposes provided that you have given us your permission. Users may opt out of our mailing list using the unsubscribe link included in the newsletter.

VIII. NOTIFICATIONS

SMS Text Messages 

If you elect to receive text messages, we will send you recurring text messages regarding your transaction activity or other requests to the mobile number you provided even if your mobile number is registered on any state or federal Do Not Call list. If you do not agree to these Text Message Terms, do not sign up for text messages. You understand that you do not have to sign up for this program in order to make any purchases, and your consent to this program is not a condition of any purchase with us. Your participation in any SMS texting program is completely voluntary.

Your wireless carrier may assess certain fees or charges associated with your use of text messaging. We are not responsible for such fees. Your carrier may restrict or prohibit certain mobile features and certain mobile features may be incompatible with your carrier or mobile device. Our text message program applies only to mobile devices registered in the United States and with United States carriers. Please review your wireless carrier’s policies and contact them if you have any questions. You acknowledge that you are at least eighteen years of age and you have the consent of the wireless account holder to sign up for text messages and pay for any related fees. We may use an automatic dialing system or automated number selection system to send you text messages. Neither we nor the carriers are liable for any delays or failures in the receipt of any text messages. Delivery is subject to effective transmission from your network operator. You are responsible for updating your number with us and ensuring your account information is correct. Messages may be sent via SMS or MMS messaging. Text messages will be transactional (in response to your registration for our Services or requests to schedule a meeting, for example) in nature.

Push Notifications to Mobile Devices

IX. CHILDREN’S PRIVACY

Our Website is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13 (or 16 where applicable by law). If you are under 13, do not use or provide any information on our Website. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, contact us as described in Section XIV below.

X. DATA RETENTION AND SECURITY

We may retain all categories of your personal information described above for as long as needed to carry out the purposes described herein or as otherwise required by applicable law. Unless we are required or permitted by law to keep your personal information for a longer period of time, when your personal information is no longer necessary to carry out the purposes for which we process it, we will delete your personal information or keep it in a form that does not permit identifying you. When determining the retention period, we take into account various criteria, such as the nature of the use of the Website, your general relationship with us, the impact on our ability to provide you the Website if we delete your personal information, mandatory retention periods provided by law and the statute of limitations, and our use of your personal information for aggregated market research.

We take technical and organizational security measures to protect the information provided via the Website from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. Do not share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we use measures to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Websites or otherwise to us. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures.

XI. ADDITIONAL INFORMATION FOR RESIDENTS OF CALIFORNIA

The California Consumer Privacy Act (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”) (Civil Code Section 1798.100, et seq.) (collectively, “California Law”), provides eligible California residents with specific rights with respect to our collection, retention, disclosing, and use of personal information. This section on Additional Information for Residents of California supplements this Privacy Policy and applies solely to eligible residents of the State of California (“consumers” or “you”) as of January 1, 2023. Any terms used but not defined in this section have the same meaning as defined in California Law.

In this section, when we talk about “personal information,” we mean information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.

A. Information We Collect

 The categories below are those identified by California Law. Please note that we have not collected or do not collect every type of personal information identified in the examples below for all Users, and the types of personal information we collect about you depends on how you interact with us and our Website. For example, we may collect different personal information from Users who only visit the Website but do not use the Platform. Similarly, we may collect data from Platform Users that we do not collect from Users who only visit the Website. The following are categories of personal information that we have collected from consumers within the last twelve (12) months: 

  • Identifiers: Such as your name, postal address, Internet Protocol (IP) address, unique personal identifiers, online identifiers, email address, telephone number, account name, or other similar identifiers. Under California Law, “unique identifiers” or “unique personal identifier” means a persistent identifier that can be used to recognize a consumer, a family, or a device that is linked to a consumer or family, over time and across different services.
  • Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)): Such as employment and employment history and financial account information.
  • Biometric information: Such as imagery of the iris, retina, or face.
  • Internet or other electronic network activity information: Such as your browsing history, search history, time spent on our Website, date and time of access, number of visits to our Website, and information regarding interactions with an internet website, application, or advertisement.
  • Geolocation data: Such as physical location or movements.
  • Sensory data: Such as audio and visual information.
  • Inferences drawn from any of the information in this Section XI(A) to create a profile reflecting preferences, characteristics, and online behavior.
  • Sensitive personal information: As set forth above, biometric information and precise geolocation information.

Please note that some of the categories of personal information described in California Law overlap with each other; for instance, your name is both an identifier and a type of data described in Cal. Civil Code 1798.80(e).

We may use (and may have used during the 12-month period prior to the date at the bottom of this Privacy Policy) your personal information for the purposes described above in Section III, “How We Use Collected Information.”

We may collect your personal information from the sources described above in Section II, “Information We Collect & How We Collect It.”

B. Information Disclosed to Third Parties for a Business or Commercial Purpose 

  • Align may disclose your personal information to third parties for a business or commercial purpose. When we disclose personal information for a business purpose, we enter into a contract that describes the purpose and requires the recipient both to keep that personal information confidential and not to use it for any purpose except in performing the contract. In the past twelve (12) months, we have disclosed the personal information categories identified in Section XI(A), “Information We Collect,” above as set forth and to the categories of third parties for a business or commercial purpose as set forth in Section IV, “Disclosing Your Personal Information.”

C. Information “Shared” With Third Parties

We may “share” (and may have shared during the 12-month period prior to date at the bottom of this Privacy Policy) the following categories of personal information about you to online advertising providers and social media platforms for the purpose of cross-context behavioral advertising:

  • Identifiers
  • Internet or other electronic network activity information
  • Inferences

You have the right to opt-out of this sharing of your information, as detailed below. We do not have actual knowledge that we share the personal information of minors under 16 years of age.

D. Your Rights With Regard to Your Personal Information

California Law provides consumers with specific rights regarding their personal information. The following section describes your California Law rights and explains how to exercise those rights. Your California Law rights include the:

  • Right to Know and Access Your Information: You have the right to request that we disclose to you your personal information that we collected, used, or disclosed. Once we receive and confirm your verifiable consumer request (see Exercising Your Rights below), we will disclose to you: 
    • The categories of personal information we collected about you.
    • The categories of sources for the personal information we collected about you.
    • Our business or commercial purpose for collecting or disclosing that personal information.

  • Right to Delete: You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. We may not be able to fulfill your request if we (or our service providers) need to retain your personal information for certain authorized purposes, such as to provide a good or service you requested, to secure our services, to protect against fraud, to improve our services, or to comply with or exercise rights under applicable law. Once we receive and confirm your verifiable consumer request (see Exercising Your Rights below), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.
  • Right to Correct Inaccuracies: You have the right to request that we correct any of your personal information that we maintain about you that is inaccurate.
  • Right to Non-Discrimination: We will not discriminate against you for choosing to exercise any of your rights. If you exercise certain rights, understand that you may be unable to use or access certain features of the Website. Unless permitted by applicable law, we will not: (i) deny you goods or services; (ii) charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties; (iii) provide you a different level or quality of goods or services; or (iv) suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
  • Right to Opt-Out of Sales or Sharing of Personal Information: We do not “sell” your personal information as defined under California Law. To opt of the “sharing” (as defined by California Law) of your personal information, please see Section XI(E), Exercising Your Rights, below. You may also opt out of “sharing” of personal information by utilizing a universal opt out mechanism recognized by our Website.

E. Exercising Your Rights

To exercise the rights described above, please submit a consumer request to us by: 

  • Visiting the self-service options in certain of our Platforms;

  • Submitting a request to us by downloading, filling out, and sending us the following pdf: here; or
  • For requests to opt out of “sharing” of personal information, as that term is defined by California Law, you may utilize a universal opt out mechanism recognized by our Website.

To exercise your right to know, access, delete, or correct your personal information as described above, we need to verify your identity or authority to make the request and confirm the personal information relates to you. Only you, your parent, guardian (if you are under 13 years or age), conservator, a person to whom you have given power of attorney pursuant to California Probate Code sections 4000 to 4465, or an authorized agent may make a verifiable consumer request related to your personal information. You may, however, make a verifiable consumer request on behalf of your minor child if necessary. We will only use personal information provided in your consumer request to verify your identity or authority to make the request. Your verifiable consumer request must provide sufficient information that allows us to reasonably verify that you are the person about whom we collected personal information or an authorized representative. If using an authorized agent, we may require written proof of the agent’s permission to make a request on your behalf and verify your identity directly. We cannot respond to your request if we cannot verify your identity or authority to make the request. You may only make a verifiable consumer request for your right to access twice within a 12-month period.

F. Response Timing and Format

Once we have verified a request from a California consumer, where required, we will confirm receipt of the request within 10 business days and explain how we will process the request. We will make our best effort to respond to a verifiable consumer request within 45 days of its receipt. We may require an additional 45 days (for a total of 90 days) to process your request, but in those situations, we will provide you a response and explanation for the reason it will take more than 45 days to respond to the request. Our responses will include required information under California Law. For right to access requests, we will select a format that is readily usable and should allow you to transmit the information from one entity to another entity without hindrance. We do not charge a fee to process your verifiable consumer request unless it is manifestly unfounded or excessive. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. 

G. Other California Privacy Rights

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. If this applies, you may obtain the categories of Personal Information disclosed and the names and addresses of all third parties that received Personal Information for their direct marketing purposes during the immediately prior calendar year (e.g., requests made in 2024 will receive information about 2023 disclosures). To make such a request, please provide sufficient information for us to determine if this applies to you, attest to the fact that you are a California resident and provide a current California address for our response. XII. ADDITIONAL INFORMATION FOR RESIDENTS OF COLORADO, CONNECTICUT, VIRGINIA, UTAH, AND OTHER STATES

Eligible residents of Colorado, Connecticut, Utah, Virginia, and states with other similar laws that may be applicable (“Covered States”) also have rights with respect to the personal information that Align collects about you. This section supplements this Privacy Policy and applies solely to eligible residents of Covered States.

Any terms not defined in this section have the same meaning as defined under applicable Covered State privacy law, including the Colorado Privacy Act, Connecticut Data Privacy Act, Utah Consumer Privacy Act and Virginia Consumer Data Protection Act (“Covered State Laws”). Subject to certain exceptions, if you are an eligible resident of one of these states, you have certain privacy rights which may include, depending on your state of residency:

  • Right to Access: You have the right to confirm whether Align processes your personal information and access such personal information. You also have the right to obtain your personal information in a portable, and to the extent reasonable feasible, readily usable format that you can transmit without hinderance.
  • Right to Delete: You have the right to request that Align delete the personal information you have provided to us or that Align has otherwise obtained about you.
  • Right to Correct: You have the right to request that Align correct inaccuracies in your personal information, taking into account the nature of the personal information and the purposes of the processing of your personal information.
  • Right to Opt Out: You have the right to opt out of the processing of your personal information for the purposes of (i) targeted advertising, (ii) the sale of your personal information and (iii) profiling in furtherance of decisions, including, for eligible residents of Connecticut, solely automated decisions, that produce legal or similarly significant effects. We do not “sell” your information as defined in Covered State Laws.
  • Right to Appeal: You have the right to appeal Align’s decision with regard to your request to exercise any rights described herein.

XIII. ADDITONAL INFORMATION FOR INDIVIDUALS IN CANADA

If you are located in Canada, this section applies to you. In certain Canadian provinces, provincial privacy legislation will apply to you, namely, for the Province of Alberta – the Personal Information Protection Act (Alberta), for the Province of British Columbia – the Personal Information Protection Act (British Columbia) and for the Province of Quebec – the Act respecting the protection of personal information in the private sector also applies to you and the expression “Canadian Privacy Laws” therefore also includes reference to these provincial laws. If you live in Canada and any part of this Privacy Policy conflicts with this section, this section governs to the extent of the conflict.

Processing of Personal Information

Personal information will only be collected, used, and disclosed by us for the purposes described above in this Privacy Policy in Sections II-VIII with your express or implied consent, if and as applicable. 

Exercising Your Privacy Rights

If you are using the Website or our other services from Canada, subject to applicable law, you have the right to access, update and correct your personal information. You may request to access, update, correct, and delete your personal information, request an accounting of who we transferred your personal information to, or request the transfer of your personal information to another entity or person by emailing or writing to us at the contact information set out below.  We may request certain personal information for the purpose of verifying the identity of the individual seeking access to his or her personal information records. If you have provided consent to our collection, use or disclosure of personal information, you can withdraw your consent at any time by contacting us at the contact information set out below. If you withdraw your consent, we may not be able to provide certain products or services to you.

To opt out of interest-based advertising, see Section II(3), “Web Browser Cookies,” Section XI(C), “Information ‘Shared’ With Third Parties,” and Section XI(D), “Right to Opt-Out of Sales or Sharing of Personal Information” above. 

You have the right to lodge a complaint about our collection, use or disclosure of your personal information with the Office of the Privacy Commissioner of Canada and any applicable provincial privacy commissioner’s office having jurisdiction.

Once we have verified a request from a user located in Canada, we will make our best effort to respond to a verifiable consumer request within 30 days of its receipt or such longer time as we may be permitted under Canadian Privacy Laws. Please be aware that under certain circumstances, Canadian Privacy Laws may limit your exercise of these rights or we may be unable to fulfill your request, and if the foregoing apply, we will inform you why.

If we cannot provide you with access to your personal information, we will inform you of the reasons why, subject to any legal or regulatory restrictions..

Marketing Communications

As indicated above, if you receive email marketing communications from Align, you can unsubscribe any time by clicking the “unsubscribe” link included at the bottom of the email. Alternatively, you can opt out of receiving our marketing communications by contacting us at the contact information under “Contacting Us” below.

Transfers to Other Countries

We are located and process your personal information in the United States. However, since we work with third-party service providers who may be located outside of the jurisdiction in which you are located, your information may also be transferred and used in regions outside of your jurisdiction and from where we operate. This means that your information may be processed in accordance with privacy laws that may be different from those in your location and may be provided in response to a search warrant or other legally valid inquiry order, or other law or legal process, which may include lawful access by U.S., Canadian or foreign courts, law enforcement or other government authorities. However, we take reasonable steps to protect your information in making such transfers.

If you are a Quebec resident, this means your personal information may be transferred outside of Quebec, including to service providers located outside of Quebec.

Privacy Governance Policies and Practices

We are committed to protecting your personal information and have implemented policies and practices that govern our treatment of personal information, including:

  • a privacy framework that defines the roles and responsibilities of our employees with respect to the treatment of personal information in our custody and control;
  • policies and procedures regarding the protection of personal information, including safeguards designed to protect personal information in our custody and control against loss or theft and unauthorized access, use or disclosure;
  • practices pertaining to privacy training and awareness for our personnel with access to personal information;
  • processes for responding to data subject requests concerning the handling of personal information in a timely and effective manner; and
  • a framework governing the retention and destruction of personal information that is designed to ensure compliance with our legal obligations.

Each employee who uses personal information is bound by confidentiality obligations and has received appropriate training. In addition, each employee may only access personal information that is necessary for the performance of his or her duties, and violation of policies relating to employee access to and use of personal information is subject to disciplinary action.
